Balancing High Risks:  Mountain Climbing and the First Amendment

When an American astronaut reverently quotes from Psalm 24, and is promptly faulted by a critic—for “violating” the so-called “separation of church and state”(1)—it is time to learn a lesson about balance, from the agility of mountain goats, adroitly ambulating alpine ascents of the Rocky Mountains.

Indeed, mountain goats provide creation science “gems”, plus a picture of how we need balance in the political arena, where Christians are routinely shoved—and told to shut up, to avoid “offending” non-Christians.  (Of course, it is offensive to Christians when they are told to “shut up”, but since when did unbelieving critics care about “offending” Christians?)

Why are mountain goats a picture of this problem? Because safely balancing a mountain goat’s body, on steep alpine slopes—and safely balancing individuals’ civil liberties (such as an astronaut’s religious freedom and free speech rights)—are both examples of high-stakes balancing acts. To appreciate this comparison (in this introductory review of the U.S. Constitution’s First Amendment), mountain goats must be matched to their intended natural habitat, just as the U.S. Constitution’s First Amendment must be matched to its intended political context.

Consider, first, the agility of a mountain goat (Oreamnos americanus), the sure-hoofed bovid that habituates the heights of North America’s Rocky Mountains and Cascade Range.(2)

“For those of us who admit to some fear of heights, the Mountain Goat is an animal to be admired … This shaggy animal, its back hunched in a manner somewhat suggestive of a Bison, is a master at negotiating the steepest of precipices. Mountain Goats are truly alpine creatures. They commonly rest on high-elevation snowfields and find most of their food among the plants of alpine meadows. Their hooves are structured to [optimize] balance and grip; the outer hoof is strongly reinforced and the bottom is lined with rubbery material, making the whole structure rather like a good hiking boot. These animals nonchalantly cross dizzying ledges, sometimes even at a trot.”(3)

In fact, the high-altitude dexterity of the mountain goat is so phenomenal that it routinely spends most of its time on precipitous terrain steeper than a 40o angle, and sometimes at pitches steeper than 60o!, especially during winter.(4)

Furthermore, the leg bones of the mountain goat are engineered to maximize a functional mix of precision balancing (such as perching all four hooves on a small spot), front-forward pulling power, propulsion leverage and maneuverability (for running and jumping), and stability (due to a low center of gravity) against tipping over.(4)

“A mountain goat climbs with three-point suspension. … Lifting one limb at a time [it] frequently pauses to assess the situation, tests the footing, and if needed turns back and selects a different route. Slow, sure consistency allows life on rock steeper than the angle of repose. Because they are most likely the ones to find themselves in a tight spot, kids do most of the go-for-broke climbing. Although a kid might take four or five missteps per year, it salvages the situation almost every time.”(4)

Thus, the mountain goats are aptly designed for moving on rocky slopes. Mountain goats are instinctively careful, and they apply their characteristic agility, as they test their environment. (Indeed, when predatory cougars try to attack them, the God-given instinct of mountain goats to flee, successfully, is often implemented by their agility and speed in and up these jagged rocky slopes and precipices!)

But without the right physical traits for maintaining balance on rugged rocks—traits which God installed on Day 6 of Creation Week—mountain goats could not thrive, as they do, upon the harsh talus slopes and felsenmeer of their high-elevation habitat.

“The [mountain goat hoofprint] track’s squarish imprint is created by the hoof’s spreading tips. The sides of the toes consist of hard keratin, like that of a horse hoof. Each foot’s two wraparound toenails are used to catch and hold on to cracks and tiny knobs. … The front edge of the hoof tapers to a point, which digs into dirt or packed snow when [it] is going uphill. In contrast to a horse’s concave hoof, which causes the animal to walk on the rim of its toenail, a [mountain] goat’s hoof has a flexible central pad that protrudes beyond the nail. The pad’s rough texture provides [skid-resistant] friction on smooth rock or ice yet is pliant enough to impress itself into irregularities on a stone. Four hooves X 2 toes per hoof = 8 gripping soles per animal. As [mountain] goats descend a slope the toes spread widely, adjusting tension to fine-tune the grip. … This feature makes them more likely to catch onto something. It also divides the downward force of the weight on the hoof so that some of the animal’s total weight is directed sideways. Because there is less net force on each downward [pressure] line, the foot is less likely to slide. Think of it as the fanning out of downward forces over numerous points of friction.”(4)

In a word, BALANCE.  God purposefully designed high-elevation mountain goats for balance, because living life among high alpine rocks is a high-risk lifestyle.

Yet the same is equally true to balancing religious liberty rights (and responsibilities) in American society.  Legitimate needs of both “church” and “state” are deliberately balanced with the God-given personal liberty rights of individuals. Like a mountain goat perched atop a precarious precipice, safeguarding those God-given religious freedoms is no lackadaisical endeavor.  The securing of those fundamental freedoms was not (and is not) easily obtained, nor is it easy to maintain those freedoms amidst the ubiquitously power-greedy politics of both “church” and “state”.(5)

In a word, the U.S. Constitution’s First Amendment is purposefully designed for BALANCE.

“Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof…”. (5)

It is to this legal text that the “separation of church and state” concept is frequently attached. However, not all opinions are equal, regarding what that phrase of 16 words (in the First Amendment) mean. Why? Because, as a matter of honesty and valid interpretation, the real meaning of any message must be matched to the message-composer’s intent.(6)

Thus, the only legitimate understanding of the First Amendment’s meaning is the understanding that matches the meaning assigned to it by the (human) source of its words.(5),(6),(7)

Yet, as a text drafted by statesmen of the late 1700s (principally by James Madison, who condensed an earlier version by George Mason), the authorial intent balanced a rejection of government-“established” church organizations, with affirmation of peaceful expression of individual religious beliefs and moral values.(6)

In other words, the First Amendment anticipated that Christians may freely express their religious viewpoints, at the personal level—yet Congress shall not officially endorse (“establish”) any specific ecclesiastical organizations, such as Baptists or Presbyterians or Anglicans or Methodists. This balancing of freedom and order—free exercise of religion, without any federal sponsorship of a particular religious denomination or hierarchy—fits the overall checks-and-balances equilibrium designed in 1791.(6)

“The real object of the First Amendment was not to countenance, much less to advance, Mohammedanism, or Judaism, or infidelity, by prostrating Christianity; but to exclude all rivalry among Christian sects, and to prevent any national establishment which should give to a [religious] hierarchy the exclusive patronage of the national government.”(8)

To put it mildly, this political balancing act is neither easily obtained nor easily maintained.  But this balance was carefully planned for–intended—by America’s founding fathers. Yet now the phrase “separation of church and state” is used to force-fit an off-balanced understanding of the First Amendment.  How did that happen?

In short, the constitutional jurisprudence of America became “evolutionized”, during the late 1800s, upsetting the proper balance between religious liberty and governmental interference.(5),(6),(7),(8),(9)

“Twentieth-century jurisprudence is based on a Darwinian world view.  Life [supposedly] evolves, men [supposedly] evolve, society [supposedly] evolves, and therefore laws and constitutions [supposedly] evolve.  According to the Darwinian principle, the Constitution’s meaning evolves and changes with time. … [Thus modern judges, implementing evolutionary humanism as jurists, my disagree about what a law “now means”] — But neither the majority nor the minority [of such evolutionary law judges] deny the basic evolutionary interpretation.  They merely question at which stage of the evolutionary scale we are!  This is not the way the founding fathers viewed constitutional interpretation.  They saw the Constitution as the supreme law, and also as a covenant or contract.  The Constitution like all legal documents was viewed as a fixed document, to be interpreted according to its plain meaning.  And if its meaning was ambiguous as applied to a specific situation, it was to be interpreted according to the intent of those who wrote it, signed it, and ratified it.  James Madison expressed this view when he wrote, ‘(If) the sense in which the Constitution was accepted and ratified by the Nation … be not the guide in expounding it, there can be no security for a faithful exercise of its powers’.”(9)

How evolutionary thinking infected American law will be reviewed, God willing, in a sequel to this introductory article.(10) Meanwhile, don’t believe it when someone tells you that the First Amendment “prohibits” an individual astronaut from reverently reading his Bible in space—or from sharing that personal fact via Facebook.(1)

And, as you appreciate the originally intended balance, designed in the First Amendment, don’t forget to thank God—for how He equipped agile mountain goats, to inhabit some of the most precarious places in the Rocky Mountains, as He exhibits (and we enjoy learning about) His creative glory and bioengineering genius.(2)

United States, 143 U.S. 457, 12 S.Ct. 511 (1892), by Justice David Josiah Brewer.  To bypass the jurisprudential relevance, of the Holy Trinity Church ruling, is to demonstrate careless misunderstanding of what the First Amendment was originally designed (and originally used) to accomplish. The balancing of civil government powers, ordained by God’s delegation, with jurisdictional limits to facilitate religious freedom, accords with relevant Scriptures, e.g., Matthew 22:21; Romans 13:1-4; Daniel 2:21 & 4:25—and with Israel’s separation of religious offices (tribe of Levi) from the monarchy (tribe of Judah).

(6) George Mason’s religious liberty tenet, which he had drafted (12 years earlier) for the Virginia Declaration of Rights, became the precursor for Virginia’s proposal (to Congress) to approve a religious freedom amendment for the “new” Constitution: “That Religion or the Duty which we owe to our Creator, and the manner of discharging it, can be directed only by Reason and Conviction, not by Force or violence, and therefore all men have an equal, natural, and unalienable Right to the free Exercise of Religion according to the Dictates of Conscience, and that no particular religious Sect or Society of Christians ought to be favored or established by Law in preference to others.” Notably, the entire Bill of Rights (i.e., Amendments 1 through 10) limited federal government powers. Ironically, most of the Constitution’s later amendments have expanded those powers. I know that I am just a bird. A Golden Eagle, in fact. But, my Heavenly Father feeds me and takes care of me. In fact, God feeds all of the animals that He created and all of the people that he created. When Jesus entered Jerusalem, a long time ago, He said that if the people didn’t shout His glory, the rocks would shout it out. They cried, “Blessed be the KING that cometh in the name of the Lord: peace in heaven, and glory in the highest.” Luke 19:38

Well, this is one eagle that wants to shout out to the glory of God!

We are destined for this city in the sky, if and only if we have accepted Jesus Christ and His death on the cross for payment for our sins. His blood is precious, and He has carried our sins away. Surely, you want to go to Heaven?

Heaven is a real place. Hell is a real place. They both exists in this present Universe. The choice is yours. In the coming days, we will take our journey through parts of the Word of God!

Hi everybody! This is Golden Eagle and I am very excited today! I got up this morning and flew around one of the beautiful lakes in my home state of Florida! The Bible says that God sends the rain and the sunshine on the good people and the bad people. God treats us all with GRACE and kindnesses!

Genesis 6:8 says that “Noah found grace in the eyes of the Lord.” That’s the first time the Bible mentions grace and the last time? It’s in the last verse of the Bible: “The grace of our Lord Jesus Christ be with you all. Amen.” (Rev 22:21)

This ADVENTURE all started in the mind of our Creator God (the Lord Jesus Christ). Hey young people, ponder the lakes, the streams, and the rivers. Ponder the rocks, the minerals, and oh yes, the gold and silver. Ponder the butterflies, the animals, and the insects. Ponder the planets, the Earth, the stars, and the sun. Ponder the Milky Way Galaxy and our beautiful Solar System. Ponder mankind, life, and all that it means. Ponder God and His created Universe.

This morning as I flew around my hometown lake I saw the sunrise in beautiful colors of splendor. I saw the sky turn different shades of red and pink. I saw the colors reflected in the glass like mirror of the still and smooth lake surface. I saw the birds fly in a V-shape formation. The white ibises were just beautiful. I flew around the lake for a number of minutes and the minutes turned into an hour.

Every moment we get closer to God. “Then shall the dust return to the earth as it was: and the spirit shall return unto God who gave it.” (Ecclesiastes 12:7) We have come from God and we are going back to God.

This ADVENTURE that God has planned for us is truly exiting. We will get to reign with Jesus for a thousand years on this very Earth. Some of you will be in charge of two or five or ten cities! Now is the time to prepare for what God has in store for us! It all starts with you admitting that you are a sinner and excepting what Jesus has done for us on the cross. He shed His precious blood to wash away our sins. Accept Jesus Christ as your personal Saviour and Lord and you will have entered this amazing journey that God has planned for us, all because of His GRACE.

Kids keep in touch and the Golden Eagle will fly in with exciting new developments in this adventurous journey. A journey that will lead to the God of the Universe and His amazing Heaven!!!

Hi boys and girls! This is Golden Eagle. I have been away for quite a while. However, I have returned and wanted to touch base with each of you for a few short moments. I hope you are enjoying your journey on planet Earth. Everyone that is born gets to start out on this marvelous journey called life. This is a gift from our Creator, the Lord Jesus Christ. God’s Word, the Bible, says

“Remember now thy Creator in the days of thy youth…”

This journey leads to God’s Heaven if you are SAVED! People get saved by trusting what Jesus Christ did on the cross about 2,000 years ago. Jesus died on an old wooden cross to pay for all the bad things we do like telling lies. The bad things we do are called sins in the Bible, but God wants to forgive you of all your sins if you will accept Jesus into your heart by faith. “For whosoever shall call (ask) upon the name of the Lord (Jesus) shall be saved.”(Romans 10:13) Why do many kids and even adults like birds so much? You know eagles can see at great distances. Sometimes, from my perch, high up in the trees I see people looking at me through funny looking glasses. I think you call them binoculars? I think you guys like us because we can FLY. Birds are not tied down to this Earth like people are! We can use our wings and sore to new heights above. You guys are tied down to Earth because of gravity. Our wings not only help us to fly. Birds are colorful and many of us sing songs pretty good as well. In the Book of beginnings called Genesis you can read about the beginning of everything, including birds! On the fifth day of God’s Creation week He created birds.

“And God said, Let the waters bring forth abundantly the moving creature that hath life, and fowl (birds) that may fly above the earth in the open firmament (space) of heaven.”

In fact, evolution teaches that modern-day birds have evolved from the dinosaurs. That’s not true, dinosaurs and birds were created at the same time! Birds were created to fly in the open space of Heaven, that’s in the air where the heavens meet the lands. In Isaiah 40:30-31 the Bible says that even kids get tired. But,

“even the youths shall faint and be weary, and the young men shall utterly fall: but they that wait (trust) upon the Lord shall renew their strength; they shall mount up with wings as eagles…”

Hey, boys and girls did you know that if you get saved you will be able to fly in the future just like birds! After Jesus died He rose again and went back to Heaven in the clouds! One time Jesus even walked on water. I tried that once and got my feathers so wet that I couldn’t fly for days. That was not a fun time for me. The Bible says in Psalm 90 that our life is “soon cut off, and we fly away.” Wouldn’t you want to fly like the birds someday? Hey, if you could do me a favor? Do you think that you could start reading your own Bible each day? So many things to learn, so many places to go, and so many things to do! If you want me to come back, me – the Golden Eagle, would you let me know? Thanks for a little bit of your time. Maybe we can take this journey of life together, what do you guys and gals think?

Boys and girls of all ages this is GOLDEN EAGLE circling in for a landing on this beautiful world that Jesus Christ created. To learn anything, to understand anything, we must have an open Bible! The other day, I heard of a 24 year-old lady that had never read the Word of God. She had no idea that the rainbow had any meaning whatsoever. Do you know the meaning behind the rainbow?  Get your Bible out and open it to Genesis chapter 9. There you will find the meaning to the rainbow.

You humans should thank God that you can read and appreciate beauty. Although I write these things once in a while, you do know that birds cannot really write and read. However, God created you to do those things and so much more.

“Blessed (happy) is the man…his delight is in the law of the Lord; and in his law doth he meditate day and night. And he shall be like a tree planted by the rivers of water. that bringeth forth his fruit in his season; his leaf also shall not wither; and whatsoever he doeth shall prosper” Psalm 1:1-3

The Word of God will bring you true success. It is no accident that you are presently reading this article. I have chosen to write this and you have chosen to read it. However, even though we both have a free will and can do what we want to do, Jesus Christ is in control of every single thing that happens in the entire Universe. He is in control of everything that you and I do, say, and think! Why even a sparrow doesn’t fall out of a tree without the Heavenly Father.

The question for you to answer is this: ARE YOU SAVED? You are either saved or lost. This has nothing to do with are you good or bad because the Bible says that “all have sinned, and come short of the glory of God.” (Romans 3:23) You’re made in the “image of God” and you will live forever somewhere according to the Bible. You can go to Heaven if you trust Jesus Christ as your personal Saviour. When Jesus died on the cross, He shed His blood and paid for your sins as your substitute. He stood in our place and took the punishment from God the Father so that you could be forgiven! You must personally accept Jesus by faith. You know, no one can eat your breakfast for you. You individually eat your breakfast and then your body makes use of the food to give you energy for the day. You must personally receive Jesus into your life!

“But as many as received him, to them gave he power to become the sons of God, even to them that believe on his name…” (John 1:12)

Golden Eagle has learned a few things as I have soared over this planet. You must study things with an open Bible. The Bible tells us where the first humans came from! You know that scientist have landed a washing machine size robot on a comet the other day. That thing has been flying around for 10 years and just arrived at its destination! That shows us how big this universe is. The comet is over 300 million miles away from Earth. The people who sent that robot to the comet are trying to find out the answer to the question: WHERE DID WE COME FROM. And that is a great question. But, they will never find the answer until they open their Bibles and begin to read the first few chapters in the book of Genesis. God created Adam on the sixth day of Creation week. He took the elements in the earth, the dust of the earth and “breathed into his nostrils the breath of life; and man became a living soul.” (Genesis 2:7)

When you study Science or History or God or whatever, you need to open your Bible and see what God has to say!

The Earth rotates around the sun. We should rotate around Jesus Christ, the Son of God. The sun gives light to the earth and Jesus is the Light of the world. Tonight, you will fall asleep and in the morning you will wake up. That is God’s way of trying to teach us that sleep is like death, but you wake up in the morning and that is like the resurrection day!

A worm goes into a cocoon and comes out a beautiful butterfly! Metamorphosis, a change teaches us that Jesus Christ will give us a new body in the future if we are saved! Humans sweat because of Adam’s sin in the Garden of Eden! The Earth is covered with water because of Noah’s flood. In fact, four-fifths of the Earth is covered with water if you count the oceans, the seas, the rivers, the streams, and the lakes!

Every snowflake is different, every blade of grass is different, every bird is different! And each one of you are unique and different. That is how God has made you! We could talk about this forever! In fact, God’s people in Heaven will talk about this and learn about God and His Universe forever. You will have a real body and be in a real Heaven with real GOLDEN STREETS!

“AND THE BUILDING OF THE WALL OF IT WAS OF JASPER: AND THE CITY WAS PURE GOLD, LIKE UNTO CLEAR GLASS…AND THE STREET OF THE CITY WAS PURE GOLD, AS IT WERE TRANSPARENT GLASS. (Revelation 21)

The question you need to ask yourself is this: will you be in Heaven with Jesus Christ in that day? And remember we are only one heartbeat away from eternity. Why not ask Jesus to save you this very moment? “For whosoever shall call upon the name of the LORD shall be saved.” (Romans 10:13)

I would love to fly to the comet later today, but I know I will not be able to get beyond the atmosphere, so I might just head back to my roost for the night and gaze into the starry heavens. Bird-Brain Might Be a Compliment!

Hey, boys and girls, Golden Eagle here. How have you been since last time? Do you ever wonder why the Universe is here? Why is the Earth here? Why are we alive? Is there something after death? Will I see my departed loved ones again? What is my purpose for existence? Where did my conscience come from? Questions are great and never be afraid to ask your parents or teachers the hard questions.

I am not a parrot! I am a high-flying eagle, but I am a little bit familiar with the Bible, the Word of God. In Revelation 4:11 the Bible says that Jesus “hast created ALL THINGS, and for thy pleasure they are and were created.” Even the animals can teach us things, if we want to learn. Do you know, a small feathered fowl just landed on my perch? I’ll be back in a minute. I need to send my feathered friend on a mission, in order to reclaim my perch.

“But ask now the beasts (animals), and they shall teach thee; and the fowls of the air (the birds), and they shall teach thee. Or speak to the earth, and it shall teach thee; and the fishes of the sea shall declare unto thee.” What will these things teach us? WHO KNOWETH NOT IN ALL THESE THAT THE HAND OF THE LORD HATH WROUGHT THIS? IN WHOSE HAND IS THE SOUL OF EVERY LIVING THING, AND THE BREATH OF ALL MANKIND.” Jesus Christ has created everything.

From the colors of the rainbow to the spots on a lady bug, Jesus created it all! Some of you have watched Disney’s Tinker Bell movies. They have water fairies, and color fairies, and Spring fairies, etc. But did you know?

Fairies are not real, but God’s angels are real!

There are Angels for the wind. (Revelation 7:1) “I saw four angels standing on the four corners of the earth, holding the four winds of the earth…”

“And I heard the angel of the waters say…” There is a water angel!

“And the fourth angel poured out his vial upon the sun…” (Revelation 16:8)

Jesus Christ created visible and invisible things! In every blade of grass, there is a lesson about photosynthesis. Our DNA is packed full with information from God. Your DNA had the information for the color of your eyes, the color of your hair, the thickness of your bones, and how tall you will eventually reach.

Water floats when it freezes! Did you ever wonder why? Most things, when they change from a liquid to a solid get heavier, but not water. Water gets lighter, and ice floats in your glass! Why? Because Jesus designed it that way, so in the winter the lakes don’t freeze solid! The ice freezes on top of the lake and fish and plants can continue to live in the winter time.

Every snowflake is different. Did you ever wonder why? “Hast thou entered into the treasures of the snow? or hast thou seen the treasures of the hail, which I have reserved against the time of trouble, against the day of battle and war?” (Job 38:22-23) You know, snow helped George Washington in the battle for America’s Independence from England. Napoleon was turned back from Russia because of the cold and snow.

You see, there are so many things to learn. The greatest of all is the learn about the Lord Jesus Christ. He is the One-true Living God. Everything was made for Him! He wants you to get saved, and then to live for Him. When you do that, you will begin to fulfill the purpose God intended you to have.

Us birds, we have our place in God’s economy! And boys and girls, you have your place. Read the Bible every day to find out more.  Sometimes, birds are smarter than you think. Maybe, if someone calls you a “bird-brain” in the future, that might be a compliment!

Hi! Gals and Guys, this is Golden Eagle flying in for a few minutes. I remembered when I woke up this morning that this is my Father’s World. The gold is His , the silver belongs to Him, and He owns the cattle on a thousand hills. I rolled out of my nest early this morning and everything was wet. You know it rained really hard yesterday night. I stretched my wings out so the glistening sunlight could warm them up. I began to preen my feathers, sometimes they get really messy in the morning. I heard the melodious songs of other birds and smiled when I thought of the goodness of God. You know, some things are so simple that we often miss them. God is spelled G-O-D and good is spelled G-O-O-D. They’re almost the same. For you see, God is good all the time. He sends the rain and the sunshine on the saved and the lost.

Jesus said “Consider the lilies of the field, how they grow; they toil not, neither do they spin: And yet I say unto you, That even Solomon in all his glory was not arrayed (dressed) like one of these.”(Matthew 6:28-29)

Jesus also said “Behold the fowls of the air: (the birds) for they sow not, neither do they reap, nor gather into barns; yet your heavenly Father feedeth them. Are ye not much better than they?” You see, the Bible tells us of the Creator-God . He says that we were created just a “little lower than the angels.” You humans are much better than us birds. You really didn’t evolve.

Hey kids, we all have our troubles and problems. When Jesus says to think about the lilies, the flowers, the fowls, and the birds He is telling us to think about God. Put your mind on the Lord Jesus Christ. We do this by reading the Bible, the Word of God. Every day we should read the Bible. And with God’s help we should believe the Word of God and try to obey the Word of God.

Psalm 1:2-3 says that “his delight is in the law of the Lord (the Word of God): and in his law doth he meditate day and night.”

He delights in the Bible and thinks about God. In my nest I have ice-cream every night because that’s what I delight in! Jesus continues, “And he shall be like a tree planted by the rivers of water, that bringeth forth his fruit in his season; his leaf also shall not wither; and whatsoever he doeth shall prosper.” Thinking about God will make you a success every time!

Focus on God, the Lord Jesus Christ, and He will work a miracle in you. Get saved and His life will flow through you and He will pour out His blessings on all the people you come in contact with. This is my Father’s world.
